These Terms of Use (the “Terms”) govern your access to and use of the website, online registration system, ticketing, and services offered by Northern Virginia Performing Arts (“we,” “us,” “our,” or the “Company”), located at 18665 Conference Center Drive, Leesburg, VA 20175. By using our website or services, registering a student, purchasing a ticket, or making a contribution, you agree to be bound by these Terms.
01Eligibility
Our website is intended for users 18 years of age or older. Persons under 18 may use our services only with the involvement and consent of a parent or legal guardian, who is responsible for all activity on the account, including payment.
02Our Services
We offer in-person performing arts classes, private lessons, workshops, productions, ticketed performances, and the opportunity to make voluntary contributions to support our programs. Our services include:
- Class and lesson registration through our website and registration platform.
- Ticket sales for performances and events.
- Voluntary contributions/sponsorships. We are a for-profit business; contributions are not tax-deductible as charitable donations.
03Account Registration
To register a student or purchase tickets, you may need to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for safeguarding your password and for all activity that occurs under your account.
04Payments, Pricing, and Billing
4.1 Pricing and Payment Processor
All prices are listed in U.S. dollars and are subject to change. Payments are processed by companies such as RegPack, HiSawyer, Square, Google Play, and Stripe, Inc. Your payment is governed by the processor’s terms and privacy policy in addition to ours. We never store full credit-card numbers on our servers.
4.2 Tuition and Class Fees
Tuition for classes, lessons, camps, and workshops is due according to the schedule disclosed at registration (e.g., monthly, by session, or paid in full). Late payments may incur a late fee. Accounts more than 14 days past due may result in suspension of the student’s participation until the balance is paid.
4.3 Tickets
Tickets are typically non-refundable except as specified at the time of purchase or required by law. If we cancel a performance, ticket holders will be offered an exchange, credit, or refund.
4.4 Voluntary Contributions / Sponsorships
Contributions made to Northern Virginia Performing Arts are voluntary and are not tax-deductible as we are a for-profit business. We will issue a receipt for your records on request.
4.5 Refund and Withdrawal Policy
Tuition is not refundable unless you pay at the time of registration for tuition insurance. At our discretion we may offer a future credit for programming at NoVAPA. 4.6 Chargebacks
If you dispute a legitimate charge with your card issuer instead of contacting us first, your account may be suspended pending resolution, and you may be responsible for chargeback fees.
05Class Conduct, Attendance, and Safety
5.1 Code of Conduct
Students, parents, and guardians agree to behave respectfully toward instructors, staff, fellow students, and audience members. We may dismiss any student or remove any guest whose conduct, in our sole discretion, is unsafe, disruptive, harassing, or otherwise inconsistent with a positive learning environment, with no refund for completed instruction.
5.2 Attendance
Regular attendance is expected. Make-up classes are offered when available but are not guaranteed. Missed classes do not accrue credit.
5.3 Health and Safety
Parents and guardians agree to keep students home if they are ill, contagious, or recovering from injury. You agree to disclose to us any condition that affects the student’s ability to safely participate.
5.4 Pickup and Drop-Off
Parents and guardians are responsible for timely pickup and drop-off of students. Late-pickup fees may apply as posted at the studio.
06Photo and Media Release
Performing arts instruction inherently involves photography and video. By registering, you acknowledge that photographs, video, or audio of students may be captured during classes, rehearsals, and performances. Use of those materials is governed by the Photo and Media Release signed at registration. You may revoke consent in writing at any time, with effect prospective only.
07Assumption of Risk; Release and Waiver
You understand that participation in dance, theater, music, voice, and other performing arts activities involves inherent risk of physical injury, including but not limited to strains, sprains, fractures, falls, and repetitive-motion injuries. By participating, you and the student knowingly and voluntarily assume all such risks.
To the fullest extent permitted by law, you, on behalf of yourself and the student and your respective heirs and assigns, release, waive, and discharge Northern Virginia Performing Arts and its owners, officers, employees, instructors, contractors, and agents from any and all claims, demands, damages, costs, expenses, and causes of action arising out of or relating to participation in our programs, except for claims arising from gross negligence or willful misconduct.
08Intellectual Property
All content on our website, including text, photographs, video, music arrangements, choreography, lesson plans, logos, and graphics, is owned by Northern Virginia Performing Arts or its licensors and is protected by U.S. copyright and trademark laws. You may not copy, reproduce, distribute, perform publicly, or create derivative works without our prior written permission, except for personal, non-commercial use as expressly permitted.
09User Content
If you submit reviews, testimonials, photos, or other content (“User Content”), you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, distribute, and display the User Content in connection with our business and marketing. You represent that you own the User Content and that it does not infringe any third-party rights.
10Prohibited Conduct
You agree not to:
- Use the website for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to our systems, accounts, or data.
- Upload viruses, malware, or harmful code.
- Scrape, harvest, or use automated tools to access the website.
- Impersonate any person or misrepresent your affiliation.
- Harass, threaten, or defame instructors, staff, or other users.
11Disclaimers
The website and all services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, secure, or error-free.
12Limitation of Liability
To the maximum extent permitted by law, Northern Virginia Performing Arts and its owners, employees, and instructors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to these Terms or your use of our services, even if advised of the possibility of such damages. Our total liability for any claim arising from or relating to these Terms will not exceed the greater of (a) the amounts paid by you to us in the twelve (12) months before the claim arose, or (b) one hundred dollars ($100).
13Indemnification
You agree to indemnify, defend, and hold harmless Northern Virginia Performing Arts and its owners, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your or the student’s violation of these Terms, (b) your or the student’s violation of any law or third-party right, or (c) your or the student’s negligent or willful misconduct.
14Termination
We may suspend or terminate your access to our website or services at any time, with or without cause, including for violation of these Terms. Sections of these Terms that by their nature should survive termination will survive, including Sections 7 (Release), 8 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law).
15Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute arising from or relating to these Terms will be brought exclusively in the state or federal courts located in Loudoun County, Virginia. You consent to personal jurisdiction in those courts. You also agree to mediation if there is a dispute.
16Class-Action Waiver
To the fullest extent permitted by law, you and we agree that disputes will be resolved on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
17Changes to These Terms
We may revise these Terms at any time. The Effective Date at the top reflects the most recent revision. Continued use of our website or services after revisions become effective constitutes acceptance of the updated Terms.
18Miscellaneous
These Terms, together with our Privacy Policy, Cookie Policy, and Photo and Media Release, constitute the entire agreement between you and us regarding our website and services. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign these Terms freely.
